​​​Direct Debit Control Centre - Terms of use

1. General

These Terms of Use govern the use of the Direct Debit Control Centre application (also ‘the application’) by you. By viewing and downloading the Direct Debit Control Centre application, you confirm you accept these Terms of Use. 

The Direct Debit Control Centre application is only available to users living in the UK. Users of the application may use the application outside of the UK. 

The Direct Debit Control Centre application is a free service provided by Bacs Payment Schemes Limited and is for your personal use only. 

The application is developed by 
Method4 Limited.The application has been developed to help users keep control of their Direct Debits. 

The Direct Debit Control Centre will allow you to:

  • Log details of your Direct Debit payments
  • Set up individual Direct Debit payment reminder notifications
  • View reminders
  • Delete reminders.

The Direct Debit Control Centre does not:

  • Have access to any payment system, nor the ability for you to send or receive payments to or from third parties**
  • Have any direct link to the actual Direct Debit Instruction as agreed by you with your bank and the service user
  • Have any direct link to the service user or your bank.

**You are advised to direct any query about your Direct Debit Instructions directly to your bank, as Bacs Payment Schemes Limited will not enter into any correspondence with you in respect of such matters. This application is not designed to enable or replicate your access to any Direct Debit Instruction or arrangement.

You can use this service if you:

  • Have compatible iPhone, iPad and Android devices
  • Reminder messages will only be available on compatible:
  • - iPhone and iPads – iOS 7+
    - Android 2.3 (Gingerbread) and up
  • Your device must have at least 64Kb of free memory.

Be aware that you are responsible for your device and any related software or hardware. Your use of the application does not entitle you to any support, upgrade, patches, enhancements or fixes (“Support”) for the service including the Direct Debit Contol Centre application. Any support that is given is at the sole discretion of Bacs Payment Schemes Limited. You shall be responsible for maintaining any equipment needed to house, access or otherwise use the application, including without limitation; hardware, software, internet access. 

We may introduce new versions of the Direct Debit Control Centre application from time to time. These will be listed on our website (www.directdebit.co.uk). 

You acknowledge that we may change, suspend or withdraw all or the use of any functionality including any database, or content, or part of the Direct Debit Control Centre application at anytime without notice or liability. 

We may also impose restrictions on your use of any part of the application at anytime without notice or liability. We will do our best to ensure that the application is able to be used and accessed by you, you accept that from time to time we may have to cease access to the application in the app iStore or Google Play store for various reasons without notice or liability to you. You may delete this application at any time by permanently deleting all software from all devices, and ceasing all access to services associated with the application at your sole responsibility.

2. PIN security

When you first use the Direct Debit Control Centre application, you will be prompted to set up a 4 digit security PIN, which you will need each time you use the application. We highly recommend that you do this. The PIN can be reset – however please note that if you choose this option, all the data i.e. existing Direct Debit reminders on the phone will be deleted for security reasons.

3. Reminder messages

iPhone / iPad devices - reminder messages will only be available on compatible iPhone / iPad devices running iOS 7+. The reminder service is limited to 64 notifications at any one time. These are created automatically in advance by the application at the time of setting up new instructions. The reminders are renewed each time you open the application or by selecting ‘View’ on the reminder message. If you do not open the application, a final notification will be sent to you reminding you to open the application. At this point the application will automatically renew the reminder notifications. 

Android devices – there are no reminder notification limits. 

Reminder messages, which are set by selecting the number of days in advance of a payment due, are based on actual days. The default reminder notice period is seven days - which will allow for weekend and bank holidays.

The application can be used abroad however please note that the alarm time for reminder messages use the device clock. Therefore if you are travelling, reminder messages will be sent based on the local time set on your device. 

We will not be liable to you for any loss incurred or damage suffered by you as a result of the failure of any application / reminder messages functionality or their failure to work.

4. Information

You are responsible for the information entered into the application. Bacs Payment Schemes Limited (or any of its members) will not be liable to you for any loss or damage for any incorrect information or as a result of the information not being accurate, complete or up to date. 

When entering data, it is important that you do not use any information related to any bank account including your bank account number. We will not be liable to you for any loss incurred or damage suffered in any respect by you or any third party as a result of any bank account information displayed on the Direct Debit Control Centre application.

5. Licence for Direct Debit Control Centre application 

We grant to you a non-assignable, non-transferable, non-exclusive Licence to use the Direct Debit Control Centre application (which shall include future updates made available to you from time to time provided you understand such updates may be subject to additional terms notified to you at the time such update is made available) subject to the following obligations and/or restrictions:

  • The application is licensed only to you and you shall not assign, sub-licence or grant any rights of use or any other rights in respect of the application to any other person
  • You shall not copy or reproduce in any way the whole or any part of the application
  • You shall not alter, modify or adapt the whole or any part of the application You shall not remove or tamper with any copyright notice in the application.

You acknowledge that the application is owned by Bacs Payment Schemes Limited, and we assert all our rights in the application that relate to design, trademarks, copyright and any other intellectual property rights. You agree that we can terminate your access to the application at anytime if you use the application for any of the following improper purposes including any breach of any law, or regulation, any malicious or objectionable purposes (at our complete discretion and judgement). Any use that causes any disruption, or interference to our or any third party networks, including any public telecommunications networks. Any disruptive use that creates or participation in the creation of any virus, or other electronic disruption to any system or data of ours or any third party. Interference with any other persons use or enjoyment of the application. We reserve the right to exercise our sole discretion in assessing whether you are in breach of this part, or any other matter.

6. Marketing Information 

Consent to use of data: From time to time we may pass information you provide (with your consent) to allow Method4 to collect and use technical data and related information in the application, including but not limited to technical information about your device, system and application software, and peripherals, periodically to facilitate the provision of software updates, product support and other services to you related to the Direct Debit Control Centre. Method4 may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

Third party materials: The application may enable your access to services and/or websites provided by Method4 and/or Bacs Payment Schemes Limited and third party providers. Use of these services and websites may require internet access and you agree to accept any additional terms of service in respect of these. You agree that all access to these services and websites is entirely at your own risk, and we cannot accept responsibility for any use that these third parties will make of any information that you provide them. You agree that neither Bacs Payments Schemes Limited nor Method4 will have any liability to you or any third party in any respect for content that may be found to be offensive, indecent, or objectionable and in all other general dealings that you have with these third parties.

7. Law and jurisdiction

These Terms of Use are governed by English Law and the English courts shall have exclusive jurisdiction to settle any dispute arising out of these Terms of Use. Our failure to rely on any of our entitlements in these Terms of Use is not a waiver of any of our legal rights in any respect. You agree that in the event any part of these Terms of Use is determined to be unenforceable, that the remainder will be binding on you as a matter of law.

8. Liability

The application is provided on an “as is” basis with no representation, guarantee or warranty of any kind offered to you (including express or implied) as to its functionality or any fitness for purpose, or merchantability or any other aspect. Bacs Payment Schemes Limited and its members will not accept any liability to you for any use of the application including without limitation, any direct, indirect, incidental, or consequential loss or damage, loss of profits, or business interruption in any respect. For the avoidance of doubt we (and any member of Bacs) do not accept any liability for any matter or dispute between you and your bank in any respect, nor do we enter into any correspondence about these issues, or any dispute that you may have in this regard. Further we will not accept liability for any misuse of the application, or for any electronic disruption of the application (by whatever means, and in whatever format) nor for any problem with any of your software or hardware that may arise. These Terms of Use do not exclude or limit liability for any matter for which liability cannot be excluded in law, any death or personal injury caused by negligence or fraud.

9. Indemnity

You agree to indemnify and hold harmless Bacs Payment Schemes Limited (and its members) from any and all liabilities, claims, actions, expenses, or costs that result from any action by you in relation to the application or any of its features, or any misuse by you of the application (or any part of the application) or from any breach of these Terms of Use. You further agree responsibility to us in respect of the preceding for any use or misuse by any person you are responsible for.​
